Précis of Covenants

 
Set out below is a brief synopsis of the covenants put in place by the developers to ensure the subdivision retains the visual link with the surrounding mountains and lake, as well as a quality living environment for residents of The Delta.

Building covenants are designed to ensure that only new dwellings sensitive to the landscape and neighbourhood are to be built. Restrictions apply to the style and type of exterior cladding and materials used, including:
 
  • Unpainted claddings or any cladding which colour is not within the approved range of muted earthen hues, and no more than two other colours from the same range.
  • No claddings which have a reflectivity of more than 40%, and any roof with a pitch of less than 30 degrees (with the exception of flat or mono pitched roofs).
  • No buildings or structures (excluding a fence) within the front yard.
  • No garages within 6 metres of an adjoining legal road.
  • No separate accessory buildings with decorative finishes and colours which are not the same or similar to those used on the dwelling.
  • All construction must be completed within 18 months.
 
Landscaping covenants are designed to ensure the development is in fitting with the character that borders a World Heritage Park and also enhances peoples enjoyment of the development, and does not detract from the surrounding lake and mountains, this includes:
 
  • No planting of certain species of exotic (introduced into New Zealand) trees or 'pest' plants.
  • No planting of any row of trees intended to create a hedgerow or shelterbelt in excess of 2 metres in height and no trees to exceed 7 metres in height from the base of the tree.
  • Not to permit any more than 20% of the surface of any Front Yard inclusive of any driveway to be covered or sealed with any impervious material and not to construct any vehicle crossing to the Lot in excess of 4 metres in width and from materials that do not compliment and blend with the footpaths.
  • No exterior lighting that is directed upwards for the purpose of illuminating a dwelling or any planting on the lot and no exterior flood lighting that would have the effect of illuminating any part of Lake Te Anau and its foreshore.
 
Fence convenants include:
 
  • No front yard fences over 800mm and no other fences over 1.8 metres above the ground.
  • Restrictions on the style and type of materials used for fences.
 
Other covenants are designed to ensure the quality of living for residents of The Delta to be maintained at all times.
 
  • No un-kept or untidy lots this includes the accumulation of rubbish or allowing lawns to become over grown.
  • No residing in any temporary structure, caravan, campervan, mobile home or tent on the lot for any one period longer than three weeks.
  • No access by any vehicle of any description to the foreshore of Lake Te Anau.
  • No further subdivision allowed.
  • Only one building per lot with its normal accessory buildings.
